Hi, i have applied my labor application eb3 in 2003 august and got approveed, applied 140 and 485 in july 2007 and i am on EAD
i came to USA on Company A in august 2000 and moved to Company B on 2003 march and applied for green card in EB3
now my company A is willing to apply my gc in EB2 and capture EB3 pd
but my lawyer says if my EB2 gets rejected they may not issue my GC saying that my new job is not same or similar (he says eb3 job which does not require Master is not same as EB2 which requires Master or 5+ years exp)
Company A and Company B are belongs to same management so the compnay is ready to do my EB2, but my lawyer is telling there is lot of risk involved

I spoke with TSC Rep today. I called up to re-check what lot of other guys are saying here that TSC no longer is honoring 180 day namecheck rule mandated by court few months back.
TSC Rep said she has no idea about 180 day rule but knows about FBI/USCIS joint effort for clearing name checks pending more than year, 2 years etc.
So atleast, my call suggested that some people at USCIS have no idea about 180 days rule mandaged by court.

Hi All,
I have H1B stamped from company A which is valid untill Oct 2008. I am planning to go to India in Jan on my new transferred H1B from company B.
Do I have to take an appointment in India for getting my new H1 stamped? Or can i just show my new approved H1B from company B on my port of entry in US, when I come back?
New Approved H1B is enough.You don't need visa stamp again.

For what it's worth, I was a Nikon pro card carrier back in the '70's. It was a FABULOUS service. I was allowed to borrow expensive gear for free that I would never have used otherwise (e.g. radio-remote release, medical telephoto with built-in ring flash, nikonos)
And the "go the head of the line" repair service saved me more than once. While I was vacationing in California I needed some urgent repairs and was told by the local main Nikon repair shop that their backlog even for "urgent" repairs was 3 months. I flashed my pro card and it was in the repair shop by 10:00 and out by noon!
